16. Limitation of Liability
16.1. Company Liability
To the fullest extent permitted by applicable by law (i) in no event will the Company or any of the Company parties (including its shareholders, officers, directors, advisors, agents, representatives, members, affiliates, or employees) be liable for any direct, special, incidental, consequential, or exemplary damages of any kind (including, but not limited to, where related to loss of revenue, income or profits, loss of use or data, or damages for business interruption) arising out of or in any way related to the sale or use of the Tokens or otherwise related to these terms, regardless of the form of action, whether based in contract, tort (including but not limited to simple negligence) or any other legal or equitable theory and (ii) in no event will the aggregate liability of the Company whether in contract, warranty, tort (including negligence), arising out of or relating to these terms or the use of or inability to use the Tokens, exceed the amount you pay to the Company for the Tokens.
16.2. Losses
The Company, its shareholders, officers, directors, advisors, agents, representatives, members, affiliates, or employees, shall not be liable for any of the following losses, including but not limited to increased or additional costs, loss of profits, loss of revenue or income, trading losses, loss of opportunity, loss of bargain, loss of time, loss of data or consequential, incidental, special, indirect losses as may be incurred or suffered by the Participant for any reason including but not limited to as a consequence of the non-exhaustive list of risks described in the Terms (even if such damages or losses are foreseeable or even if the Company has been advised of the possibility of such damages or losses).
16.3. Regulatory Authority
No regulatory authority has authorised and reviewed any of the information set out in these Terms and/or the Documents. No such action has or will be taken under the laws, regulatory requirements, or rules of any jurisdiction.
16.4. Indemnification
The Participant agrees to indemnify the Company for any legal fees or other costs that are incurred by the Company or any other indemnified parties as a result of the Participant’s actions or omissions.
16.5. Company Responsibility
The Company shall not be responsible for any losses or damages in connection with force majeure events, including acts of God, earthquakes, storms, pandemics (whether declared by the Government of Gibraltar under relevant legislation such as the Civil Contingencies Act 2007 or by the World Health Organisation), other nature events, embargoes, riots or orders of government, acts of terrorism or war; any labour disputes or other industrial disturbances; reliance on any information contained in the Terms, any error, omission or inaccuracy in any such information or action resulting from such information.
